Preseden Baik untuk Pelindungan Awak Kapal Indonesia: Kasus Santunan Alm. Irmawanto

Setelah hampir satu tahun perjuangan, sebuah langkah monumental dalam pelindungan awak kapal Indonesia akhirnya membuahkan hasil. Tim Advokasi DPP Serikat Awak Kapal Transport Indonesia (SAKTI) berhasil mengawal dan memastikan terpenuhinya hak-hak ahli waris dari Alm. Irmawanto, seorang awak kapal Indonesia yang meninggal dunia akibat sakit saat bekerja di atas kapal MV. Ocean Phoenix berbendera Singapura milik Ocean Phoenix Pte Ltd.

Almarhum mengembuskan napas terakhirnya pada 1 Desember 2023 ketika kapal berlabuh di Pelabuhan Hong Kong. Dalam duka dan ketidakpastian, pihak keluarga memberikan surat kuasa pada 26 Februari 2024 kepada tim advokasi DPP SAKTI untuk mengurus hak-hak yang menjadi bagian dari perjanjian kerja almarhum. Berdasarkan Perjanjian Kerja Laut (PKL) atau Seafarer Employment Agreement yang telah disepakati antara almarhum dan perusahaan, ahli waris berhak atas santunan kematian sebesar USD 60.000, ditambah USD 30.000 sebagai santunan untuk dua anak almarhum yang masih di bawah umur—total keseluruhan sebesar USD 90.000.

Proses ini sempat melalui mekanisme Work Injury Compensation Act (WICA) di Singapura, yang merupakan sistem kompensasi kecelakaan kerja yang diatur oleh Kementerian Ketenagakerjaan Singapura (MOM). Namun, setelah proses verifikasi dan validasi yang sangat ketat, kasus almarhum tidak memenuhi kriteria untuk kompensasi melalui WICA. Maka, tim advokasi kembali menggunakan mekanisme berdasarkan ketentuan yang termaktub dalam PKL.

Keberhasilan penyelesaian kasus ini tidak lepas dari peran dan kerja sama banyak pihak. Kami mengapresiasi kerja profesional dan kooperatif dari pihak manning agency, PT Indomaritim Management, yang sejak awal terbuka dan aktif membantu proses penyelesaian. Ucapan terima kasih juga kami sampaikan kepada pihak owner kapal dan koresponden P&I Club di Jakarta yang telah memberikan dukungan nyata dalam pemenuhan hak-hak ahli waris.

Kasus Alm. Irmawanto menjadi preseden penting dalam pelindungan awak kapal Indonesia di kapal asing. Ini menunjukkan bahwa hak-hak pelaut Indonesia dapat diperjuangkan hingga tuntas, selama terdapat kesepakatan yang jelas dalam perjanjian kerja dan terdapat mekanisme pelindungan yang didukung secara profesional oleh pihak-pihak terkait.

Kami berharap keberhasilan ini dapat menjadi pembelajaran sekaligus pemicu perbaikan sistem pelindungan bagi pekerja migran sektor maritim, khususnya awak kapal. Sudah saatnya negara hadir secara konkret dan terintegrasi dalam menjamin pelindungan kerja pelaut Indonesia—baik melalui regulasi nasional maupun pemanfaatan norma internasional seperti Maritime Labour Convention (MLC) 2006 yang sudah diratifikasi Indonesia melalui UU No. 15 Tahun 2016.

Pelaut bukan hanya pekerja, mereka adalah penjaga nadi logistik dunia. Sudah semestinya hak mereka dipastikan, bahkan setelah mereka tiada.
