Hilangnya LCT CITA XX: Kegagalan Sistem dan Tuntutan Keadilan untuk Para Korban

Jakarta, [15.01.2025] – Tragedi hilangnya kapal LCT CITA XX beserta 12 orang awak di dalamnya kembali menyoroti lemahnya pengawasan dan transparansi dalam proses penerbitan Surat Persetujuan Berlayar (SPB) di Indonesia. Kapal yang berlayar dari Pelabuhan Pomako menuju Pelabuhan Yahukimo pada 14 Juli 2024 itu hilang kontak hingga kini, tanpa kepastian lokasi maupun nasib para korban.

Kasus ini menyeruak ke ranah publik ketika keluarga korban menunjuk Kantor Hukum Yogi Pajar Suprayogi and Partner’s sebagai kuasa hukum mereka pada 22 Oktober 2024. Tim hukum yang terdiri dari Ogi Pajar Suprayogi, A.Md., S.E., S.H., dan Heri Susanto, S.H., M.H., C.Me, bersama Sekretaris Jenderal Serikat Awak Kapal Transportasi Indonesia (SAKTI), Syofyan Elcomandante, segera bergerak untuk menuntut keadilan. Dari investigasi awal, tim hukum mendapati sejumlah kejanggalan serius dalam penerbitan SPB oleh Kantor Unit Penyelenggara Pelabuhan (UPP) Kelas II Pomako.

Keganjilan dalam Penerbitan SPB

Berdasarkan Pasal 13 ayat (1) dan (2) huruf a Peraturan Menteri Perhubungan Nomor 28 Tahun 2022 tentang Tata Cara Penerbitan Surat Persetujuan Berlayar dan Persetujuan Kegiatan Kapal di Pelabuhan, syahbandar memiliki kewenangan untuk menolak penerbitan SPB apabila kapal tidak memenuhi persyaratan administrasi yang dipersyaratkan. Namun, SPB untuk LCT CITA XX tetap diterbitkan meskipun kapal tersebut diduga tidak memenuhi persyaratan.

“Kami mencurigai adanya persekongkolan oleh oknum di Kantor UPP Kelas II Pomako yang memungkinkan kapal ini berangkat tanpa memenuhi syarat. Ini tidak hanya melanggar aturan, tetapi juga menempatkan nyawa manusia dalam bahaya besar,” ujar Ogi Pajar Suprayogi.

Lebih lanjut, Syofyan Elcomandante, Sekjen SAKTI, menambahkan, “Negara harus tegas untuk segera menyatakan status kapal dan awak kapal tersebut demi memberikan kepastian hukum, baik bagi keluarga korban maupun pemilik kapal terkait hak dan kewajiban mereka.”

Langkah Hukum dan Lambannya Respons Pemerintah

Sebelum melaporkan kasus ini ke pihak kepolisian, tim hukum telah mengajukan somasi kepada Kantor UPP Kelas II Pomako serta meminta klarifikasi kepada Dirjen Hubla Kementerian Perhubungan RI. Sayangnya, tidak ada tanggapan yang memadai dari kedua institusi tersebut. Hal ini dinilai mencerminkan buruknya pelayanan publik dalam menyelesaikan masalah yang menyangkut keselamatan nyawa manusia.

Karena tidak adanya respons yang memadai, tim hukum resmi melaporkan dugaan tindak pidana pemalsuan surat ke Bareskrim Polri. Laporan Polisi Nomor LP/B/21/I/2025/SPKT/BARESKRIM POLRI diajukan pada 14 Januari 2025 dengan mengacu pada Pasal 263 KUHP tentang pemalsuan dokumen.

“Kami berharap aparat penegak hukum dapat mengusut kasus ini hingga tuntas dan memberikan keadilan kepada para korban,” tegas Heri Susanto.

Tuntutan untuk Reformasi Sistem Pelayaran

Kasus ini tidak hanya menjadi tragedi kemanusiaan tetapi juga menunjukkan adanya celah besar dalam pengawasan sistem pelayaran di Indonesia. Kejadian ini mengingatkan kita bahwa keselamatan pelayaran tidak boleh dikompromikan oleh kelalaian atau potensi praktik korupsi.

Syofyan Elcomandante menyampaikan bahwa SAKTI mendukung penuh langkah-langkah hukum yang diambil untuk mengungkap kebenaran di balik hilangnya kapal LCT CITA XX. “Kami tidak hanya menuntut keadilan bagi keluarga korban, tetapi juga mendesak pemerintah untuk melakukan reformasi total terhadap sistem penerbitan SPB dan pengawasan pelayaran agar kejadian seperti ini tidak terulang,” ujarnya.

Harapan bagi Para Korban

Keluarga korban kini menanti kepastian hukum dan keadilan atas hilangnya orang-orang yang mereka cintai. Langkah hukum yang telah diambil diharapkan dapat menjadi titik awal dalam mengungkap tabir kelalaian dan praktik tidak bertanggung jawab yang menyebabkan tragedi ini.

Kasus LCT CITA XX menjadi peringatan keras bagi pemerintah dan seluruh pihak terkait untuk tidak bermain-main dengan keselamatan pelayaran. Nyawa manusia adalah prioritas utama yang harus dijaga, dan tragedi ini harus menjadi pelajaran berharga agar reformasi di sektor pelayaran segera dilakukan demi menciptakan sistem yang lebih aman dan transparan.

Dengan harapan keadilan dan kepastian hukum yang segera terwujud, perjuangan ini tidak hanya untuk 12 awak kapal LCT CITA XX, tetapi juga untuk mencegah terulangnya tragedi serupa di masa depan.
