Perlindungan Awak Kapal Perikanan

Ada pun sembilan perwakilan organisasi pelaut niaga, pelaut perikanan, dan organisasi masyarakat sipil yang mengajukan permohonan menjadi Pihak Terkait, adalah SERIKAT AWAK KAPAL TRANSPORTASI INDONESIA (SAKTI), dan Serikat awak kapal perikanan bersatu. Sakti sulawesi utara (SAKTI Sulut).

Lalu, Serikat Pelaut Sulawesi Utara (SPSU), Pelaut Borneo Bersatu (PBB), Serikat Pelaut Bulukumba (SPB), Serikat Buruh Migran Indonesia (SBMI), @Greenpeace Indonesia Indonesia, @Indonesia Ocean Justice Initiative (IOJI), dan @Destructive Fishing Watch (DFW) Indonesia.

“Mereka semua tergabung dalam Tim Advokasi Pelaut Migran Indonesia (TAPMI),” jelas dia.

Tentang klaim dari para pemohon uji materi UU 18/2017, disebut oleh Jeanny Silvia Sari Sirait tidak tepat. Hal itu, karena pihaknya menilai jika klausul yang dimaksud kemudian dihapus, maka itu akan merugikan para pekerja migran di sektor pelayaran. Baik itu kapal niaga atau kapal perikanan.

“Jadi sangat keliru bila pihak Pemohon menganggap UU PPMI merugikan Pelaut,” tegas dia.

Sekretaris Jenderal SAKTI Syofyan El Comandante juga menyatakan tidak sepakat jika klausul penghapusan klausul pekerja migran benar-benar terjadi. Pasalnya, pihak yang akan menerima dampak buruknya, tidak lain adalah pelaut Indonesia, karena mereka akan bekerja tanpa payung hukum yang melindungi.

Jika status pekerja migran bagi awak kapal niaga dan pelaut perikanan dihilangkan dari UU 18/2017, maka Peraturan Pemerintah (PP) Nomor 22 Tahun 2022 tentang Penempatan dan Pelindungan Awak Kapal Niaga Migran dan Awak Kapal Perikanan Migran tidak berlaku lagi sebagai aturan turunan dari UU tersebut.
