Medan. Sakti.or.id- Seorang Pelaut Berinisial (NP) dengan jabatan Third Engineer (3/E ) bekerja di kapal MV. CEMCON telah mendapat Pemutusan Hubungan Kerja (PHK) sepihak Tanpa Diberikan Kompensasi Sisa kontrak yang telah di Sepakati oleh pihak PT . WNS Dengan alasan Belum Lulus Masa Percobaan.

(NP) Pun mengadukan kepada Sp. Sakti yang hingga akhirnya Syofyan Selaku Sekjend Sakti Mendatangi PBH ( Pusat Bantuan Hukum ) Peradi untuk berkonsultasi Terkait Pemutusan Hubungan kerja tersebut agar di Gugat ke PHI. 16/02/2023

Jika salah satu pihak mengakhiri hubungan kerja sebelum berakhirnya jangka waktu yang ditetapkan dalam PKWT bukan karena salah satu ketentuan di atas, maka pihak yang mengakhiri hubungan kerja wajib membayar ganti rugi kepada pihak lainnya sebesar upah pekerja sampai batas waktu berakhirnya jangka waktu perjanjian kerja.

Selain itu, pengusaha wajib memberikan uang kompensasi yang besarannya dihitung berdasarkan jangka waktu PKWT yang telah dilaksanakan oleh pekerja. Sesuai dengan PP 35 tahun 2021 Tentang Perjanjian Kerja waktu tertentu, Alih Daya ,Waktu Kerja Dan Pemutusan Hubungan Kerja “Tegas nya”.
