Sembilan Bulan Kapal LCT Cita XX Hilang kontak: Negara Harus Hadir Menjamin Kepastian Nasib dan Hak Awak Kapal

DPP SAKTI   menyampaikan keprihatinan mendalam atas hilang kontaknya  kapal LCT Cita XX   dalam pelayaran dari Pomako,Timika menuju Yahukimo, Papua  yang hingga kini, setelah lebih dari Sembilan bulan, belum ditemukan dan belum ada kejelasan mengenai nasib 12 orang ( termasuk ABK ) yang berada di atas kapal tersebut.

Yang lebih memprihatinkan, hingga saat ini tidak ada penetapan resmi status kapal maupun ABK oleh instansi terkait, serta tidak ada proses penyelesaian atas hak-hak ketenagakerjaan awak kapal yang hilang. Padahal, kasus ini menyangkut keselamatan jiwa manusia, hak-hak pekerja, dan tanggung jawab negara terhadap warga negaranya.

Kementerian Perhubungan dan Negara Harus Bertindak Tegas

Kami menilai bahwa Kementerian Perhubungan, khususnya melalui Subdirektorat Kepelautan, dan Direktorat lalu Lintas dan Angkutan laut telah gagal menjalankan tanggung jawabnya untuk memberikan kepastian hukum dan perlindungan terhadap awak kapal Indonesia. Tidak adanya penetapan status “hilang” atau “presumed lost” terhadap kapal dan ABK LCT Cita XX, menunjukkan lemahnya mekanisme negara dalam menangani kasus kecelakaan pelayaran yang berdampak pada pekerja maritim.

Kami menuntut Kementerian Perhubungan untuk:

  • Menetapkan status resmi kapal dan awak kapal LCT Cita XX, sebagai dasar hukum untuk memproses hak-hak ketenagakerjaan.
  • Memanggil dan memeriksa pemilik kapal untuk memastikan tanggung jawab mereka terhadap ABK.
  • Membuka informasi dan proses investigasi secara transparan kepada publik dan keluarga korban.

Kepastian Hak Ketenagakerjaan Awak Kapal Adalah Kewajiban Negara

Hingga kini, keluarga ABK tidak mendapatkan kejelasan mengenai:

  • Status Upah para awak kapal,
  • Kompensasi atau asuransi kematian,
  • Penggantian barang pribadi yang hilang dalam pelayaran.

Padahal, Indonesia telah meratifikasi Maritime Labour Convention (MLC) 2006 melalui UU No. 15 Tahun 2016, yang mewajibkan negara untuk menjamin pemenuhan hak-hak awak kapal, termasuk dalam keadaan darurat atau kehilangan nyawa di laut.

Kami menegaskan bahwa negara tidak boleh berdiam diri dalam menghadapi kasus ini. Setiap keterlambatan penanganan sama dengan membiarkan para keluarga awak kapal hidup dalam ketidakpastian dan penderitaan yang berkepanjangan.

Tuntutan Kami

  1. Kementerian Perhubungan segera menetapkan status hukum kapal LCT Cita XX dan ABK-nya.
  2. Pemilik kapal diminta bertanggung jawab penuh atas nasib dan hak para awak kapal.
  3. Komnas HAM, Ombudsman, dan DPR RI melakukan pengawasan terhadap proses penanganan kasus ini dan memastikan adanya keadilan bagi keluarga korban.

Penutup

Kami menyerukan kepada semua pihak, baik pemerintah, parlemen, masyarakat sipil, dan media massa untuk tidak membiarkan kasus ini tenggelam dalam diam. Nyawa awak kapal Indonesia harus dihargai, hak-hak mereka harus dijamin, dan negara harus hadir sebagai pelindung, bukan penonton.

DPP SAKTI siap berkoordinasi dengan keluarga ABK, advokat, maupun institusi terkait untuk mendorong penyelesaian kasus ini secara adil dan bermartabat.
