Jakarta, 23 Februari 2025 – Insiden tenggelamnya kapal tanker MT Silver Sincere berbendera Malaysia pada 12 Januari 2025 di perairan Tanjung Berakit, Kepulauan Riau, kembali menyoroti lemahnya perlindungan terhadap awak kapal Indonesia yang bekerja di kapal asing. Kapal yang diawaki oleh tujuh Warga Negara Indonesia (WNI) dan satu warga negara Myanmar ini mengalami kebocoran yang menyebabkan kapal tenggelam. Beruntung, seluruh awak kapal berhasil diselamatkan oleh KN.Sarotama dan MN.Intan daya 368 dievakuasi ke Tanjung Uban, Bintan.
Setelah melalui serangkaian interogasi dan memberikan keterangan kepada pihak berwenang, para awak kapal menghadapi ketidakjelasan nasib. Pemilik kapal tidak menunjukkan itikad baik untuk memenuhi tanggung jawabnya terhadap para awak. Pada 18 Februari, para awak kapal mengajukan pengaduan ke Serikat Awak Kapal Transportasi Indonesia (SAKTI). Tim advokasi SAKTI segera menghubungi pemilik kapal melalui email, yang kemudian merespons dengan menerbitkan surat jaminan untuk memenuhi kewajibannya, asalkan para awak kembali ke Malaysia untuk menyelesaikan formalitas sign off dan izin kerja. Namun, dengan pertimbangan keselamatan, para awak menolak kembali ke Malaysia.
Ironisnya, oknum syahbandar dan agen kapal yang ditunjuk oleh pemilik kapal justru meminta para awak untuk menandatangani surat pernyataan yang menyatakan bahwa mereka ikhlas tidak menerima gaji dan pulang dengan biaya sendiri. Meskipun SAKTI telah berkoordinasi dengan pihak berwenang terkait keselamatan para awak, hingga Sabtu malam tidak ada respons yang memadai. Akhirnya, 2 orang ( 1 WNI dan 1 Mynmar ) masuk ke Malaysia dan 6 orang awak kapal memilih untuk pulang ke rumah masing-masing dengan biaya sendiri, tanpa mendapatkan hak-hak mereka.
Kasus ini mencerminkan lemahnya perlindungan hukum bagi awak kapal Indonesia yang bekerja di kapal asing. Meskipun Undang-Undang Nomor 18 Tahun 2017 tentang Pelindungan Pekerja Migran Indonesia telah mengatur perlindungan bagi pekerja migran, implementasinya masih jauh dari harapan. Selain itu, tumpang tindih peraturan dan kurangnya koordinasi antar lembaga terkait memperburuk situasi ini.
Diperlukan upaya serius dari pemerintah untuk memperkuat regulasi dan memastikan penegakan hukum yang efektif guna melindungi hak-hak awak kapal Indonesia. Selain itu, peningkatan kesadaran dan edukasi bagi para awak kapal mengenai hak-hak mereka sangat penting agar mereka tidak mudah dieksploitasi oleh pihak-pihak yang tidak bertanggung jawab.
Insiden MT Silver Sincere seharusnya menjadi momentum bagi semua pihak untuk berbenah dan memastikan bahwa kejadian serupa tidak terulang di masa mendatang.
